April 17, 2007 - CNYK 8001-C Issued

The Central New York Railroad has reissued CNYK 8001, Switching Rules and Miscellaneous Charges, the most recent version is 8001-C effective April 23, 2007.  Changes in this document include revised Special Train Service charges, Item 300, and a new Mileage Based Fuel Surcharge, Item 700.  A copy of CNYK 8001-C is attached for your information and will be posted on our internet site, www.cnyk.com, for your future reference.  Please note that CNYK 8001-C issued April 5, 2007 cancels CNYK-8001-B.

The Mileage Based Fuel Surcharge, Item 700, is being implemented to comply with the Surface Transportation Board’s decision of January 26, 2007.  The new mileage based fuel surcharge, MBFSC, is calculated on a shipment’s rail route of movement mileage, based on a shipment’s origin, destination and intermediate railroad interchanges, times the fuel surcharge rate which is indexed to highway diesel sale prices.  The mileage based fuel surcharge will apply on public rate documents issued by the CNYK effective April 23, 2007.

The new mileage based fuel surcharge is indexed to the U.S Department of Energy, Energy Information Administration's published monthly average price of U.S. No. 2 Diesel Retail Sales by All Sellers (HDF #2). In calculating the surcharge, the CNYK will use the published EIA monthly average two months prior to the current month. Beginning at 200.0 cents per gallon HDF, and for each incremental 4 cents per gallon, CNYK will charge a 1 cent per mile per railcar for every 4 cents per gallon, or portion thereof (one-way) fuel surcharge from origin to destination.  Shipment mileage will be calculated using ALK Technologies’ PC*Miler/Rail data base.  More details of the MBFSC are contained in the attached reissue of CNYK 8001 - Series.

The CNYK’s public rate documents are being reissued with an effective date of April 23, 2007.  The reissued documents will reflect market based adjustments and are subject to the new MBFSC.  The MBFSC will also be applied to future contracts and quotes issued by the CNYK.

The CNYK will continue to issue monthly updates of our fuel surcharge rates and post this information on our internet site.  The original fuel surcharge rate will be maintained until private agreements utilizing its provisions expire.

March 31,2007 - CNYK to Revise Fuel Surcharge and Reissue Tariffs.

The Surface Transportation Board (STB) served the railroad industry with a decision on January 26, 2007 in which it was determined that the format of the railroad industry's fuel surcharges should be based on the mileage of rail car shipments.  Railroads are required to comply with this decision within 90 days.

The Central New York Railroad's current fuel surcharge provisions do not comply with the STB's decision.  To comply with the STB ruling, the CNYK is reformulating our fuel surcharge provisions.  The new mileage based fuel surcharge will apply on all public rates effective April 23, 2007.

Effective April 22, 2007 the CNYK will cancel all public rate documents issued by the CNYK that are subject to the fuel surcharge provisions contained in CNYK 8001-A.  

The public rate documents being canceled by the CNYK effective April 22, 2007 are:

The reissue of these rate documents will have an effective date of April 23, 2007.  These documents will be subject to a mileage based fuel surcharge.  The reissue of these documents will be completed by April 3, 2007.
